Former advisor to the DRC president acquitted of conspiracy against the head of state

The High Military Tribunal of the Democratic Republic of Congo (DRC) on Thursday acquitted Francois Beya, former special security adviser to President Félix Tshisekedi, who had been prosecuted for three years for conspiracy against the head of state and "inciting military personnel to commit acts contrary to discipline."

The court also acquitted two other defendants, while sentencing two soldiers who had already served their sentences in pretrial detention, according to the Congolese news site Actualité. However, earlier this month, the Prosecutor's Office requested a one-year sentence for Beya and his co-defendants, including six months of probation, citing health-related mitigating factors.

Beya, 69, was arrested in February 2022 for his alleged involvement in an attempted coup and held for seven months before being released on medical grounds. In August, he traveled to France for treatment and has been living there ever since.

Before his arrest, he was a key figure in Congolese intelligence and served under Mobutu Sese Seko (1971-1997), Laurent-Désiré Kabila (1997-2001), his son Joseph Kabila (2001-2019) and Tshisekedi (2019-present).
