Criminal conviction and judicial proceedings

The court found the repeated abuse to be proven and applied the term of particularly aggravated sexual abuse in the context of actual repetition. This classification allowed the events to be consolidated into a single ruling and a sentence commensurate with the proven severity. The sentence mandates 12 years of imprisonment and leaves the defense open to possible appeals to a higher court. The Prosecutor's Office maintained that the sentence responds to the need to protect the victim and prevent future misconduct by the aggressor.

The Court sentenced a 56-year-old man to 12 years in prison for repeatedly abusing a 12-year-old girl in the department of Durazno. The case came to court after a complaint was filed on April 22 at the Ninth Precinct of Sarandí del Yi, where the specialized unit for domestic and gender violence began the investigation. The Prosecutor's Office explained that the accusation pointed to repeated crimes of particularly aggravated sexual abuse and that the evidence led to the conviction. The sentence entails the transfer of the convicted man to prison to serve the sentence imposed by the court.

During the investigation, the judge ordered a 120-day pretrial detention order upon formalizing the case, a measure that remained in place until the case was resolved. The case file included statements, expert reports, and other measures that corroborated the existence of repeated abuse, according to judicial sources. The victim, a minor, became pregnant as a result of the incident, a factor that exacerbated the severity of the crime. Institutional and social authorities supported the case from the initial complaint, following the process until the sentencing.
